Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BlockPress app for Shopify ("BlockPress", the "App"), operated by BlockPress ("we", "us", "our"). By installing or using the App you agree to these Terms.

1. The Service

BlockPress is a Shopify app that helps merchants create, optimize, and publish blog content on their Shopify storefronts. The Service includes:

  • A block-based article editor with AI-assisted drafting, rewriting, and SEO optimization.
  • Built-in SEO and UX scoring.
  • Bulk article health auditing.
  • On-page analytics for published articles.
  • Autosave, version history, and saved templates.
  • Author management and standalone author pages.

We may add, modify, or remove features at any time. Material reductions in functionality will be announced at least 30 days in advance.

2. Accounts and access

You must have an active Shopify store and a valid Shopify account to use BlockPress. You are responsible for:

  • Maintaining the security of your Shopify account.
  • All content created, edited, or published through your account.
  • Ensuring you have the right to publish all content (text, images, video) you submit through the App.

3. Acceptable use

You agree NOT to use BlockPress to:

  • Publish content that infringes third-party intellectual property rights.
  • Generate or distribute defamatory, fraudulent, or unlawful content.
  • Spam, harass, or threaten others.
  • Attempt to access, scrape, or interfere with other users' data.
  • Reverse-engineer, decompile, or attempt to extract the source code of the App.
  • Use AI features to generate content prohibited by Anthropic's Usage Policy.

We may suspend or terminate access for any violation of this section without notice.

4. AI-generated content

BlockPress offers AI features powered by Anthropic's Claude models. You acknowledge that:

  • AI output may be inaccurate, biased, or incomplete. You are responsible for reviewing all AI-generated content before publishing.
  • You retain ownership of AI output you generate through your account, subject to Anthropic's terms.
  • You may not represent that AI-generated content was authored by a human if your jurisdiction or industry requires disclosure (e.g., FTC endorsement guides).
  • We do not warrant the accuracy, originality, or fitness of AI-generated content for any purpose.

5. Subscriptions and billing

5.1 Plans

BlockPress is offered on tiered subscription plans (Free, Growth, Pro, Agency). Plan limits, included AI generations, and prices are listed at /pricing.

5.2 Charges

All paid subscriptions and overage charges are processed by Shopify Billing as line items on your monthly Shopify invoice. By upgrading to a paid plan you authorize Shopify to bill you on a recurring 30-day cycle until you cancel.

5.3 AI overage

Paid plans include a monthly quota of AI generations. Calls beyond your included quota are billed at the per-generation rate displayed on the pricing page, capped at $50 per billing period by default (raisable on request).

5.4 Free tier

The Free tier is offered without payment but with feature and quota limits. We may modify or discontinue the Free tier with 30 days' notice.

5.5 Refunds

All charges are non-refundable except where required by law. If you believe you've been billed in error, contact billing@blockpress.app within 14 days.

5.6 Trials

Trial periods, when offered, require a Shopify subscription to be set up but no charge is processed until the trial ends. Cancel during the trial to avoid being charged.

6. Intellectual property

6.1 Your content

You retain all rights to articles, images, and content you create or upload through BlockPress. You grant us a limited license to host, store, transmit, and display your content solely to provide the Service.

6.2 Our IP

The App, its code, design, brand, and documentation are owned by BlockPress and protected by copyright. These Terms do not grant you any rights to our trademarks or trade dress.

7. Service availability

We aim for 99.5% uptime on a monthly basis but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (Shopify, Vercel, Supabase, Anthropic), and force majeure events may cause interruptions. We are not liable for losses caused by such interruptions.

8. Termination

You may uninstall the App at any time from your Shopify admin. Upon uninstallation:

  • Active paid subscriptions are cancelled automatically by Shopify.
  • We delete all shop-scoped data within 7 days of receiving Shopify's shop/redact webhook (which fires 48 hours after uninstall).

We may terminate or suspend your access if you breach these Terms, fail to pay charges, or use the Service in a way that risks legal or operational harm to us or others.

9. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR ALWAYS AVAILABLE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) USD $100 OR (B) THE FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the App and via email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Lee County, Florida, and you consent to that jurisdiction.
